The Azerbaijani Exiled Civic Coalition (AZEX), represented by the Institute for Human Rights (IHR) and the Institute for Reporters` Freedom and Safety, condemns the Azerbaijani authorities for the arrest of disabled human rights defender Famil Khalilov and calls for his immediate release.<\/p>\n

AZEX considers Khalilov’s arrest as another egregious example of unjust and politically motivated persecution within the framework of the authorities’ widespread repression campaign against civil society representatives ahead of the UNFCCC COP-29, during which dozens of prominent journalists and human rights defenders have been arrested, bringing the total number of political prisoners to 300.<\/p>\n

Khalilov, who requires constant assistance due to paralysis of both arms, was subjected to an unjustified police operation on May 2 of this year.<\/p>\n

Approximately 50 police officers raided his home, where Khalilov lived with his wife and three young children. During the search, police planted a small packet of white powdered substance in the kitchen cabinet and then detained Khalilov, his wife, and children, taking them to the police station.<\/p>\n

Khalilov himself was subjected to torture at the police station for several hours, demanding him to unlock his smartphone and laptop, which police confiscated during the raid.<\/p>\n

Seeing that Khalilov refused to unlock his devices, police began to pressure his two minor daughters. Initially, police took Khalilov’s 11-year-old daughter, Shems Khalilova, to a separate room and subjected her to psychological pressure for 20 minutes, without the presence of parents or lawyers, demanding her to unlock her father’s phone and computer. After receiving a refusal from the 11-year-old, police subjected Khalilov’s 8-year-old daughter, Gemar Khalilova, to the same psychological pressure, and she succumbed, unlocking her father’s smartphone.<\/p>\n

Khalilov’s wife, Kichikhanum Khalilova, was also subjected to moral pressure and insults, demanding her to unlock her husband’s computer. During the interrogation, police asked Khalilov’s wife who has been helping him to write critical anti-government posts on social media, considering that Khalilov is completely incapacitated in both hands.<\/p>\n

After explaining that Khalilov himself can operate his computer and smartphone using his feet and the tip of his nose, police released Khalilov’s wife and children a couple of hours after the arrest, demanding her not to communicate with journalists and not to disclose the circumstances of Famil Khalilov’s arrest to anyone.<\/p>\n

While his wife and children were released, Khalilov himself was detained as a suspect in drug possession and trafficking. Two days later, the court ruled his detention for 4 months.<\/p>\n

During the first 3 days after his arrest, Khalilov was not allowed access to his lawyer, and he was not provided with the medication and dietary food he needed. Khalilov, who requires constant assistance from others, was placed in a detention center that is absolutely unsuitable for people with disabilities.<\/p>\n

AZEX believes that the authorities’ rage against Khalilov is due to his activity on social media, especially on the TikTok platform, where Khalilov’s videos reach thousands of views. That is why, having gained access to Khalilov’s smartphone, the police deleted all the posts and materials on TikTok.<\/p>\n

In his posts, the human rights defender raised issues related to the violation of socio-economic and political rights of people with disabilities, children, the elderly, and women. Famil Khalilov actively raised issues with the disadvantages of the healthcare and social security system, as well as environmental pollution in Azerbaijan.<\/p>\n

Earlier, due to concerns for his life, Famil Khalilov was forced to migrate to Sweden in 2015, where he lived with his wife and children for about 8 years. Swedish migration authorities, mistakenly believing that nothing threatened Famil Khalilov in Azerbaijan, denied him refugee status and forcibly deported him together with his wife and kids back to Azerbaijan in July 2023.<\/p>\n

AZEX calls on the Swedish government to urgently engage in consultations with the Azerbaijani authorities to assist in the release of Famil Khalilov and provide support to his family members.<\/p>\n

AZEX demands that the Azerbaijani authorities immediately release Famil Khalilov and end his politically motivated persecution.<\/p>\n

AZEX calls on the Azerbaijani authorities to release all representatives of civil society and independent media who have been subjected to mass repression in recent months, including the recently arrested prominent human rights defender Anar Mammadli. AZEX believes that the politically motivated arrest of Anar Mammadli is due to his work in exposing falsifications during the recent extraordinary presidential elections and the upcoming extraordinary parliamentary elections, which the authorities have decided to hold before the COP-29.<\/p>\n

AZEX calls on UN member states to demand that Azerbaijan fully ensure freedom of assembly, association, and expression in the run-up to the upcoming COP-29 Climate Conference, and provide safe conditions and opportunities for representatives of local and international civil society and media.<\/p>\n

AZEX calls on the Azerbaijani authorities to immediately repeal repressive laws adopted in recent years to restrict the functioning of civil society institutions, independent media, and political parties.<\/p>\n
