LAWSUIT OF ELECTION MONITORING AND DEMOCRACY EDUCATION CENTER AGAINST JUCTICE MINISTERY NOT FULFILLED

Today, 2 September, in the Yasamal District Court, under the chairmanship of Judge Ragib Gurbanov, a hearing was conducted on the lawsuit of Election Monitoring and Democracy Education Center against Justice Ministry to consider the refusal by the ministry to register the NGO unfounded and in connection with violation of association.

Plaintiff’s representative, Election Monitoring and Democracy Education Center Program Coordinator, Bashir Suleymanli participated in the hearing. Representative on behalf of the defendant did not participate in the hearing.
Judge issued a decision not to fulfill the lawsuit.
Election Monitoring and Democracy Education Center Program Coordinator, Bashir Suleymanli told IRFS that they will file an appeal against the decision of the court.
EMDEC’s documents submitted on 26 January 2009 to the Justice Ministry’s Registration and Notaries Chief Department were returned on 29 April 2009 noting that they were not in order. The founders of EMDES evaluated the actions of the Justice Ministry as contradictory to the law and filed a lawsuit against the Justice Ministry in the Yasamal District Court. The Yasamal District Court rejected the lawsuit three times.
