ЖУРНАЛИСТЫ ПОДАЛИ КАССАЦИОННУЮ ЖАЛОБУ

A cassation complaint has been filed on the case of nine journalists that weren't allowed to attend imprisoned former Minister of Health Ali Insanov's court trial.

The head of Legal Enlightenment Society Intigam Aliyev told the Institute for Reporters' Freedom and Safety the document was signed by all of the nine journalists and sent to the Supreme Court on 6 February 2008.   
Recall that Elshad Mammadov ("Yeni Musavat" newspaper), Elshan Mammadaliyev ("Gundelik Azerbaijan" newspaper), Tarana Kazimova ("Turan" Information Agency), Fikrat Huseynov ("Azadlig" newspaper), Chingiz Sultanov ("Realniy Azerbaijan"), Haji Zeynalov ("Ayna-Zerkalo newspaper), Vazeh Mehdiyev ("Baki Khabar" newspaper), Ramiz Nejefli (independent journalist), and Sabuhi Nasibov ("Zerkalo") filed a lawsuit in the Sabail District Court against the Grave Crimes Court and its judges and against the Justice Ministry’s court administrators and officers under articles 6 (right to fair investigation), 10 (speech freedom), and 14 (prohibition of discrimination) of the European Human Rights Convention. Sabayil District Court Judge R. Ahamadov rejected the complaint, stating that his court does not have the authority to preside over the abovementioned case.   
Later the journalists sent the complaint to the Nasimi District Court on 15 May 2007. In the court Judge H. Khalilov rejected the complaint on the basis of the 11 April 2007 verdict. The reason indicated for the document’s return was that the form and content on the complaint were not in accordance with regulations. A complaint against this decision was filed, but the appellate court, under the chairmanship of Judge Ismayil Valiyev, examined and rejected it on 15 May 2007.  
The journalists involved in the complaint didn’t receive a copy of this decision within five days, and appealed to the Supreme Court, Court Rights Council, Justice Ministry and Appellate Court to resolve this matter and discipline the judges responsible for investigating this case. It was only was after this appeal that the journalists were able to obtain this decision and file a complaint against it.
