COURT PARTIALLY FULFILLS JOURNAL’S APPELLATE COURT COMPLAINT

Today in the appellate court a hearing was held under the chairmanship of Judge Akif Isgandarov on the appeal filed on the lower court’s decision about "Korrupsiya va Jamiyyat" (Corruption and Society) journal and the publication’s editor-in-chief Mammad Ahmadoglu.

Editor-in-chief Mammad Ahmadoglu and lawyer Afandizade Abdulla participated in the hearing on behalf of the journal, while the other side was represented by lawyer Namig Alekberov.  Afandizade asked the court to revoke the decision. Namig Alakbarov recalled article 158 (measures for fulfilling lawsuits) of the Civil Procedural Code and said that it is possible to ban the defendant from taking certain actions. "I think the decision should be upheld without any changes," said Alekberov.


After listening to both sides, the judge left for deliberation.. Upon returning, he announced his decision. According to the decision, with the exclusion of the articles published about Namiq Alakbarov, the ban on dissemination of materials about Great Britain citizen Adeola Agbabika was annulled, but the decision adopted on 22 October was upheld.

Recall that, Great Britain citizen Adeola Agbabika and Namig Alekberov filed a lawsuit in Yasamal District Court against "Korrupsiya va Jamiyyet" journal and the journal's founder and chief editor Mammed Ahmedoglu. The lawsuit stems from the articles "The Judge's oath and appetite" and "How Nigerian swindler's lawsuit against the Justice Ministry was fulfilled according to 1,350,000 USD" which were run in 2007, in the ninth edition of the journal.

On 4 October 2007, during a hearing on this case in the Yasamal District Court Judge Khagani Tagiyev adopted a decision that until this case is resolved in court "Korrupsiya va Jamiyyet" journal and the journal’s Editor-in-Chief Mammad Ahmadoglu are forbidden from disseminating any material about this case or the plaintiffs Great Britain citizen Adeola Agbabika and lawyer Namig Alakbarov. According to the decision adopted on 22 October, the case on the lawsuit of Adeola Agbabika was held unconsidered.

*It was declared that today’s hearing would be open, and in connection with this the Institute for Reporters' Freedom and Safety appealed to the court in the written form to get permission to record and take pictures during today’s hearing. Judge Isganderov rejected this appeal.
