EUROPEAN COURT IN DISCUSSION WITH AZERBAIJAN GOVERNMENT OVER MEDIA LICENSE

European Court of Human Rights opened discussions with the Azerbaijan government regarding the appeal by DM-TRV Television and Radio Company (founded in 1991 and based in Balakhan), reported the company’s lawyer Intigam Aliyev.

The company applied to the National Television and Radio Council (NTRC) for a license in 2003, but the Council refused.
The company filed a lawsuit against the State Radio Frequency Office of the Ministry of Communications and Information Technology, State Commission on Frequency, and National Television and Radio Council (NTRC) in October of 2005.
Sabail District Court rejected the lawsuit on 31 October, 2006. The Appeals Court and then the Supreme Court upheld the decision. The company appealed to the European Court regarding the lawsuit on the violation of freedom of expression, as established under Article 10 of the European Convention for Protection of Human Rights and Fundamental Freedoms. The appeal emphasizes that the right to a fair trial (Article13) was violated and the company was discrimination against, which is banned under Article 14.
