FATULLAYEV SUES GENERAL PROSECUTOR

Imprisoned journalist Eynulla Fatullayev is suing the General Prosecutor of Azerbaijan, Zakir Garalov, reported Fatullayev’s lawyer Anar Gasimov.

According to the lawyer, the lawsuit, filed at Sabayel District Court last week, demands that General Prosecutor apologize for violating his right to be presumed innocent.  
The lawsuit alleges that the General Prosecutor violated the right to the presumption of innocence during the investigation of terrorism charges against  Eynulla Fatullayev, for which he has been acquitted.
BACKGROUND
In 2007, Eynulla Fatullayev, editor-in-chief of “Realniy Azerbaydjan” and “Gundelik Azerbaycan” newspapers, was sentenced to 8.5 years in jail for threatening terrorism, amongst other charges. However, on April 22, 2010, the European Court of Human Rights ruled for his immediate release and financial compensation from the Azerbaijani government (27,800 EUR). The Azerbaijani Supreme Court Plenum has only partially fulfilled the decision.
