HEARING CONDUCTED AGAINST MUBARIZ MASIMOGLU

Yesterday, 15 April, in the Yasamal District Court, under the chairmanship of Judge Tahir Ismayilov, a hearing on the court case opened in the Yasamal District Police Investigation Department against Assistant Editor-in Chief of "Korrupsiya ve Jamiyyat" (Corruption and Society) Journal Mubariz Masimoglu and citizen Shakir Abbasov under article 221.2 (hooliganism) of the Criminal Code took place.     

Plaintiff M. Asadova, defendants Shakir Abbasov, Mubariz Masimoglu and defense lawyer Hidayet Rustambeyli participated in the hearing.
State plaintiff Alakbar Rzayev’s motion was fulfilled and two police – Gasimov Maharram and Nasirov Jeyhun were called to the court and interrogated. They talked generally about where and how the incident happened, but stated that they did not witness it; however, they brought S. Abbasov and M. Masimoglu to Yasamal District Police due to a complaint by a woman (M. Asadova).
Although Judge T. Ismayilov allowed the employees of the Institute for Reporters’ Freedom and Safety to take photos during the last hearing, he did not permit this during yesterday’s hearing. When “Azadlig” Newspaper correspondent Elchin Selcug objected to this, Judge T. Ismayilov dismissed him from the court hall.
Elchin Selcug was allowed in the court hall after he complained to the Chairman of the Yasamal District Court.
Injured party Emil Jarchiyev did not participate in the hearing and therefore the next hearing was scheduled to take place on 17 April at 2:00 p.m.
This lawsuit stems from a dispute which happened on public bus #218 between assistant editor-in chief of "Korrupsiya ve Jamiyyat" Journal Mubariz Masimoglu, Maleyka Asadova and Emil Jarchiyev in August 2008. A criminal case was opened against Mubariz Masimoglu in the Yasamal District Police Department under article 221.2 (hooliganism).
