Public Prosecutor Seeks 3.5-Year Jail Sentence for NGO Activist Elchin Hasanov

Nizami District Court, chaired by judge Mazahir Sadigov, held a hearing on the hooliganism case against Elchin Hasanov, deputy Editor-in-Chief of the Yukselis.info website, and Deputy Director of the NGO Legal Education of Sumgait Youth. The criminal case against Hasanov was opened on March 3, 2016, under Article 221.1 (hooliganism) of the Criminal Case. On March 4, the case was reclassified from Article 221.1 (hooliganism) to Article 221.3 (hooliganism, committed with a weapon) of the Criminal Code. According to the indictment, Elchin Hasanov and Jafar Jafarov – previously unacquainted – insulted each other on Facebook. Following their online exchange, they met in person, and Elchin Hasanov allegedly kicked Jafar Jafarov for no reason and assaulted him with a blunt metal object unknown to the investigating authority. Hasanov’s legal representative is Fariz Namazli.
At today’s hearing, forensic expert Naila Abilova, who had given the forensic medical opinion about the victim in Elchin Hasanov’s criminal case – Jafar Jafarov, testified.
According to expert’s opinion, the medical examination results showed that Jafar Jafarov had suffered abrasions on his right cheek and the front surface of his neck and that this injury had been caused by a blunt object.
In response to lawyer Fariz Namazli’s question as to what was meant by a blunt object, the expert said fists, fingernails and objects not having the function of cutting.
As for the lawyer’s second question on how the scrapes on Jafar Jafarov’s right cheek could appear, the expert said they might be caused by a fingernail or a ring worn on a finger.
The public prosecutor spoke at the hearing and noted that the charge brought against Elchin Hasanov was proved by the expert opinion and other evidence. The prosecutor requested that Elchin Hasanov be sentenced to 3.5 years in jail and be arrested in the courtroom.
Lawyer Fariz Namazli asked the court to give him time to prepare for the defense speech and the hearing was postponed.
The next hearing will be held on May 18, at 10.15am.
