Today, July 5th, Supreme Court considered the appeal filed against 3 March 2011 resolution of the Court of Appeals by Rasul Jafarov and Yasar Agazadeh, who sued the National Television and Radio Council for refusing to give them a radio license. The judge Ali Rustamov presided over the hearing.
The appellants’ lawyer Elchin Sadigov told IRFS that Judge Rustamov upheld the decision of the appellate court and refused to grant the appeal.
BACKGROUND
Jafarov, the founder of the TV and Alternative Media Development Centre, and independent journalist Yashar Agazadeh applied to the NTRC for a radio broadcast license for a Baku and Absheron frequency. The NTRC told them that there were a number of available frequencies, but refused to assign them an official frequency or grant them a license. The plaintiffs asked the courts to condemn this illegal behavior by the government, and to compel the NTRC to give them a license. The lawsuit was rejected by the Sabail District Court. On March 3, 2011, the Appeals Court refused to grant the appeal sent against the court decision.
