SUPREME COURT PARTIALLY FULFILLS CITIZEN’S APPEAL

On June 7th, 2011, the Supreme Court heard the cassation appeal filed against the February 17 2011 decision of Baku Appeals Court regarding the criminal case launched against citizen Yagub Muradzade.

Muradzade was demanding the termination of the criminal case against him. Judge Imran Hajigayibov presided over the hearing. The court partially fulfilled the appeal and annulled the Baku Appeal Court’s decision, and transferred the case back to the Appeals Court for reconsideration, Muradzade told IRFS today.
BACKGROUND
The head of Yasamal District Executive Power Ibrahim Mehdiyev sued Yagub Muradzade, claiming that he had been insulted and defamed in complaint letters Muradzade wrote to different state bodies. Under the December 15 2010 ruling by Yasamal District Court, Muradzade faced a 500 AZN fine, under a charge based on Article 147.1 of the Criminal Code. He was acquitted of libel, but faced an additional 1000 AZN fine for charges based on Article 148 (insult).
Yagub Muradzade is editor-in-chief of “Yeni Gazet” newspaper, published 2004-2006, but not currently operating.
