Today Supreme Court heard the annulment complaint against the decision issued by the Appellate Court on 3 December, 2010 on the lawsuit of the Center for Election Monitoring and Democracy Education (CEMDE) against the Justice Ministry regarding its refusal to register the organization. Judge Islam Aliyev presided over the hearing.
Plaintiff Bashir Suleymanli and lawyers Sadig Bagirov took part in the hearing. However, there was nobody representing the Justice Ministry.
The Supreme Court rejected the cassation complaint and upheld the Appeals Court 3 December 2010 decision.
BACKGROUND
CEMDE Chairman Anar Mammadli and founder of the organization Bashir Suleymanli appealed to the Justice Ministry for state registration on the 26th of January, 2009. However, the Justice Ministry said that there are various problems with the organization’s documents and refused to register them. Then the Center for Election Monitoring and Democracy Education (CEMDE) appealed to the Yasamal District Court. On the 2nd of September, 2009 the decision was issued to reject the lawsuit. On the 17th of December, 2009 Appellate Court upheld the decision of the Yasamal District Court. Then the organization appealed to the Supreme Court. Supreme Court sent the case to the Appellate Court for reconsideration on 13 August, 2010. On 3rd of December, 2010, the Appellate Court rejected the lawsuit. The plaintiffs filed an annulment complaint against this decision.
