Today, 29 September, in the Sabail District Court, under the chairmanship of judge Araz Huseynov, a hearing was held on the criminal case opened under articles 221.2.1 (hooliganism) and 127 (inflicting intentional minor bodily harm) against young bloggers Emin Abdullayev (Millli) and Adnan Hajizade.
Defendants’ lawyers Elton Guliyev and Isakhan Ashurov objected to the failure of the injured party to participate in the hearing. The judge asked the injured party’s representative to secure the participation of the injured party in the next hearing.
At that point, the witness accounts were listened to. First witnesses introduced by the plaintiff – three police employees of the Sabail District Police Department witnessed during the hearing. There were many contradictions in the witness accounts of all three witnesses. They answered “I do not remember” to all questions from defense lawyers. Although all of them stated that they took Adnan Hajizade, Emin Milli and Orkhan Gafarli directly to the police unit #9 after the incident, Emin Milli asked the judge to speak and said that this issue should be investigated thoroughly. “We went to the police department #39 ourselves, and we then were taken to the police unit #9 in a police car,” said Emin Milli. Defense witness Orkhan Gafarli confirmed Emin Milli’s statement.
Then, defendants’ witnesses Orkhan Gafarli and Parviz Atayev gave witness accounts. Both of them said that they were in the restaurant with Adnan and Emin when the incident happened. They emphasized that Vusal hasanov came up to their table and asked Emin Milli, “What are you saying?” Although Emin Milli told him that he did not understand him, V.Hasanov repeated his question decisively and hit his head to Emin’s. After this Hasanov hit Adnan Hajizade, and the dishes on the table broke after it fell over. The witnesses added that they (people sitting at the same table with Adnan and Emin) wanted to separate them, but Babek Huseynov, who was sitting at the same table with Vusal, came up to them and did not let them. P.Atayev added that he left to call police, but found Emin and Adnan lying on the ground after he came back. Vusal was on top of them and restaurant employees were trying to separate them by holding his waist.
The judge scheduled the next hearing for 1 October at 3:00 p.m.
On 8 July, at approximately 8:00 p.m., Emin Milli and Adnan Hajizade were sitting at a table in “Lebonese” (Livan) restaurant along with several other young adults, when two people that looked like sportsmen came up to them, and attacked them causing physical injuries. Although they appealed to police as victims, police detained Adnan and Emin as suspected persons for 48 hours and freed the attackers. On 10 July, the Sabail District Court issued a decision under article 221.2.1 (hooliganism) of the Criminal Code to sentence Emin Milli and Adnan Hajizade to two months pre-trial detention. On July 20 the Appellate Court upheld the decision of the lower court. The investigation of the criminal case was concluded and a criminal case under articles 221.2.1 (hooliganism) and 127 (inflicting intentional minor bodily harm) was opened against E.Millli and A.Hajizade and the case was sent to court to be considered.
