Sabail district prosecutor’s office refused to institute criminal proceedings over the beating of Tofig Yagublu, a member of the coordinating center of the National Council and the “Musavat” Party.
This was reported to Turan by Yagublu himself. According to him, January 11, the prosecutor’s office sent a letter to his lawyer as saying that “there are no grounds for a criminal case in this case,” said Yagublu.
Lawyer Neimat Kerimli called the refusal of the prosecutor’s office “absurd.
According to him, the prosecutor’s office motivated its decision by Article 39.1.1 of the Criminal Procedure Code – “the absence of an event of crime.
“This is utter absurdity. “The “event of a crime” is obvious: Tofig Yagublu was detained by police in front of a dozen people and journalists, and a few hours later he appeared before the public with serious injuries on his face,” said the lawyer.
This was confirmed by a medical examination. “If the doctors had written that they ‘found no evidence’ of Yagublu’s beating, another matter. He noted that the defense would appeal the decision of the prosecutor’s office in court.
It should be reminded that Yagublu was detained and severely beaten during a protest in Baku on December 1. He was kept in custody until the evening and had been beaten.
Yagublu filed a complaint to the Prosecutor’s Office of the Sabail district and testified for 4.5 hours on December 3, following which he was sent for medical examination.
According to Yagublu, he was beaten at the 39th police station in Sabail district, then he was taken outside the city and dumped from a car 72 km west of Baku.
