Aydin Janiyev’s appeal denied

Today Shirvan Appeals Court under judge Ismayil Ahmadov held a hearing on the appeal filed by Khural newspaper correspondent Aydin Janiyev against the ruling of the Lankaran City Court.

The case was opened with the testimony by victim Mirbaba Tahirov. He claimed that he had been assaulted and insulted by Janiyev. But Janiyev denied it, adding that he only broke the windows of the mosque and asked the court to punish him for this offense only.

 

Public prosecutor Jeyhun Aliyev called the appeal unfounded and asked the court to uphold the previous decision.

 

Lawyer Elchin Sadigov, in his turn, noted that the lawsuit against Janiyev was once again proved to be unfounded, claiming that there were contradictions in the victim’s testimony. He asked the judge to grant Janiyev’s appeal and acquit him.

 

After a brief deliberation the judge denied the appeal.

Janiyev was arrested on September 7th 2011 following a lawsuit by religious followers of Sarpakaran village in Lankaran region.  He was charged with breaking the windows of the village mosque and insulting the religious followers, and then sentenced to 12 days of administrative arrest. Later a criminal case under Article 221.2.2 (hooliganism committed with resistance to the authorities acting to protect social order or to prevent the infringement of a social order, or with resistance to another person) was launched, and on September 20th Lankaran City court sentenced him to 2 months of pre-trial detention. On November 21st he was sentenced to 3 years in jail.
