Natig Adilov provided the court with information about the information request he sent, including the date it was sent. In response to this Bayramova said, “In ‘Access to Information’ Law 21 article 11 (refusal to execute information request) directly states that a person can refuse to respond, and her client exercised this right and sent a response saying she refused to respond. If this did not arrive, it is not our fault.”
N. Aliyeva noted that in the law “Access to Information” it also states that information requests must be responded to within seven days. However, to this day a response to the information request sent by Adilov on 29 November 2007 still has not come. Taking this into consideration, Aliyeva asked the court to adopt a decision regarding failure to respond to an information request.
The judge ordered the defense to present to the court a receipt showing they sent a response to the plaintiff, and scheduled the next hearing on this case for 4 April 2008 at 11:30 a.m. Recall that the previous hearing on this case was postponed because the defense could not introduce this receipt.
This lawsuit stems from a information request sent by Adilov on 29 November 2007 to the State Students Admission Committee about how Royala Najafov (popular singer Roya) got accepted into Baku State University. According to Adilov this information request was never responded to. The plaintiff is seeking to have the court adopt a decision that State Students Admission Commission Chairperson Malayka Abbaszade must honestly and fully respond to the information request and for a decision to be adopted in accordance with Civil Procedural Code 265.1 that Abbaszade be held responsible for violating relevant legislation.
