DELAYS IN CONSIDERATION OF ILGAR NASIBOV’S CASSATION COMPLAINT

There are delays in consideration of the cassation complaint filed in the Republic of Azerbaijan’s Supreme Court against the Nakhchivan Autonomous Republic’s Supreme Court 18 January 2008 verdict on a lawsuit against “Radio Liberty” correspondent Ilgar Nasibov for alleged defamation.

The case was to be considered on 10 June at 10:30 a.m., but was postponed for unknown reasons. Up to today, June 20, no new date has been appointed for consideration of the complaint, Nasibov told the Institute for Reporters’ Freedom and Safety.

Nasibov said that such delays are intentional to prevent him to appeal to the European Court of Human Rights against the “unfair” decision adopted against him.

Recall that on 6 December 2007 I. Nasibov was sentenced to three months of imprisonment, however he was released on the basis of an Appellate Court decision dated December 10. However, on the same day the Nakhchivan City Court also handed down to I.Nasibov a one year suspended sentence on the basis of a different lawsuit put forth by Nakchivan State University Director, parliamentarian Isa Habibbeyli, and employees of the same university Emin Ujar and Nizami Aloyev.
