GEORGIA’S PROCURATOR’S OFFICE EXPRESSES POSITION ON NOT SURRENDERING SUSPECTED PERSONS ON MURDER OF ELMAR HUSEYNOV

Georgia’s Chief Procurator’s office confirmed that the request for surrendering the suspected persons on the murder of Monitor journal editor-in-chief Elmar Huseynov Teymuraz Aliyev and Tahir Khubanov was denied.

According to the “Media forum” website, on 11 March, Georgia’s Chief Prosecutor’s Office International Relations Department Prosecutor Nana Rapava said that several times Azerbaijan appealed to Georgia to surrender T.Aliyev and T.Khubanov. “But our country’s constitution forbids surrendering Georgian citizens to another country; therefore, we haven’t been able to fulfill Azerbaijan’s request,” said N.Papava.
N.Rapava answered positively to the question, “Is there any contract regarding mutual legal assistance between Azerbaijan and Georgia?” but stressed that T.Aliyev and T.Khubanov are citizens of Georgia, and the constitution prohibits surrendering Georgian citizens to other country, “That is why we refused to fulfill the request.”
N.Rapava said that it is outside of her authority to answer the question whether T.Aliyev and T.Khubanov are in the territory of Georgia or not, and The Ministry of Internal Affairs can respond to this question.
A criminal case was opened regarding the murder of Elmar Huseynov, who was killed on 2 March, 2005, but the executors and people behind his murder have not been found to this day. Azerbaijan law-enforcement organs stated that the suspected Georgian citizens Teymuraz Aliyev and Tahir Khubanov hide in Georgia.
