HEARING HELD ON LAWSUIT OF ELECTION MONITORING AND DEMOCRACY EDUCATION CENTER AGAINST JUCTICE MINISTRY

Today,  31 August, in the Yasamal District Court, under the chairmanship of Judge Raqib Gurbanov, a hearing was held on the lawsuit of Election Monitoring and Democracy Education Center against Azerbaijan Republic Justice Ministry to consider the refusal by the ministry to register the NGO unfounded and in connection with violation of association.

Plaintiff’s representative, Election Monitoring and Democracy Education Center Program Coordinator Bashir Suleymanli and his lawyer, Law Enlightenment Society Chairperson Intiqam Aliyev, and defendant’s representative Etibar Musayev participated in hearing.   
I.Aliyev asked the judge to adopt a decision to consider the case on the essence, to institute 10 000 AZN in compensation against the defendant, and to require that the ministry register the organization.
The representative of the defendant demanded that the lawsuit be considered unfounded and rejected.
Judge Ragib Gurbanov scheduled the next hearing for 2 September at 3:00 p.m. to announce the decision.
The judge did not permit IRFS correspondents to film or take photos.
EMDEC’s documents submitted on 26 January 2009 to the Justice Ministry’s Registration and Notaries Chief Department were returned on 29 April 2009 noting that they were not in order. The founders of EMDES evaluated the actions of the Justice Ministry as contradictory to the law and filed a lawsuit against the Justice Ministry in the Yasamal District Court. The Yasamal District Court rejected the lawsuit three times.
