HEARING HELD ON LAWSUIT OPENED BY BAKU CITY POLICE DEPARTMENT CHIEF AGAINST JOURNALIST AND LAWYER

Yesterday, April 12th, Yasamal District Court heard the lawsuit filed by Baku City Police Department Chief Rafig Abbasov against Bizim Yol newspaper employee Haji Zeynalov, and lawyer Khalid Bagirov. Judge Elchin Gurbanov presided over the hearing.

At the hearing were the plaintiff’s attorney Radik Ahmadov and representative Rovshan Alasgarzade, the Baku City Police Department legal advisor, the defendants, and legal representation Anar Gasimov, Mukhtar Mustafayev, Javad Javadov, along with Haji Zeynalov’s lawyer.
Haji Zeynalov said that he has familiarized himself with the content of the lawsuit. Later Khalid Bagirov’s lawyers stated that the plaintiff himself must attend the hearing, because there is no warrant of attorney. Citing the lack of warrant for the attorney, they demanded that the court dismiss the plaintiff’s attorney from the process and reject the case.
Judge Gurbanov rescheduled the process for 15 April with regard to discussion of the motion.
Baku City Chief of Police Rafig Abbasov filed a lawsuit against Bizim Yol reporter Haji Zeynalov and lawyer Khalid Bagirov under Article 147.2 (serious libel), based on the March 1 2011 article by Haji Zeynalov, which was called “Those arrested need a baton, not a lawyer” and “Lawyer Khalid Bagirov offers to hold protests with this slogan”. He claims the article was nothing but slander. According to him, in the second article, the author claims that citizen Elvin Asgarov was beaten to death at Police station #25 of Nizami District Police Office, which he denies.
