HEARING LAUNCHED ON ELMIN BADALOV`S LAWSUIT AGAINST ASOA

Today the Baku Appeals Court heard the appeal of former Azerbaijan State Oil Academy (ASOA) student Elmin Badalov,l against the Nasimi District Court 2 February 2011 decision, which refused to fulfill the second lawsuit of the fired student against the Academy and its rector Siyavush Garayev, Badalov told IRFS.

According to Elmin Badalov, he and his representative Fariz Namazli, defendant attorney Ilgar Javadov and the Dean of the Oil and Mechanics Faculty of ASOA Gasim Mammadov attended the hearing. The ASOA said that Badalov can resume his education in the 4th year, if he repeats the exams on the subjects he studied in his 1st, 2nd, and 3rd years. Badalov argued against this.
The Judge scheduled the next hearing for 2 June, 2011.
BACKGROUND
Elmin Badalov was expelled from the State Oil Academy on 19 January, 2010. On 12 November 2009 Bedelov published on the pia.az website an article called “Reportage from Azerbaijan State Oil Academy”,on incidents of bribery and financial fraud at the University. The student-journalist claims that the harassment he faced and his failures at university are due to his journalistic activity. He filed a lawsuit at Nasimi District Court to restore his right to education. On 5 April, 2010 the Nasimi District Court rejected Badalov’s lawsuit against Azerbaijan State Oil Academy and Rector Siyavush Garayev. On 2 July, 2010, Baku Appeals Court upheld this decision. On November 23, the Azerbaijani Supreme Court upheld the Appeals Court decision.
