Hilal Mammadov’s appeal to be referred to court of appeals

Today (August 09) Nizami District Court chaired by judge Mehriban Garayeva heard the appeal of Tolishi-Sado newspaper editor-in-chief Hilal Mammadov for the delay of the post delivery of his appeal.

Mammadov’s lawyer Anar Gasimli noted that on July 25 they appealed against June 22 decision, which sentenced Mammadov to pre-trial detention. However due to oversight of the postal service employees the date was written as July 26 on the letter, which resulted in the rejection of the appeal. The deadline to appeal against a decision is 72 hours. Gasimli says that the date on the receipt for posting the letter is 25 July. Therefore the decision about the missing the deadline is unfounded.
 
The public prosecutor suggested that the receipt might be fake and noted that it is impossible that the dates on the receipt and on the letter does not coincide.
 
After deliberation the judge decided that the deadline was not missed and ordered to refer the appeal to the court of appeals.
 
Tolishi-Sado editor-in-chief Hilal Mammadov was detained on June 21st 2012. Nizami District Police Office opened a criminal case against him under article 234.4.3 (illegal manufacture, purchase, storage, transfer, transport or sale of drugs in a large quantity). If convicted under this Article Mammadov may face confiscation of his property and imprisonment for up to 12 years. On June 22nd, Nizami District Court sentenced Hilal Mammadov to 3 months of pre-trial detention. He is currently held in Baku Investigative Prison. On July 3rd Hilal Mammadov faced new charges under Articles 274 (high treason) and 283 (inciting national, racial, social and religious hatred, hostility and ethnic discrimination).
