JALAL ALIYEV RESCINDS HIS LAWSUIT AGAINST AZER AYKHAN

Today, 4 may, in the Baku Appellate Court, under the chairmanship of judge Faig Gasimov, a hearing was held on the appeal of MP, academic Jalal Aliyev’s against the 10 February, 2010 decision of the Nizami District Court regarding Jalal Aliyev’s special format lawsuit against Yeni Musavat newspaper’s deputy editor-in-chief Azer Aykhan and the newspaper’s correspondent Goshgar Bakili. 

Plaintiff representative Mezahir Sadigov, defendants Yeni Musavat newspaper deputy editor-in-chief Azer Aykhan and his lawyer Elchin Sadigov participated in the hearing.

Lawyer M.Sadigov presented Jalal Aliyev’s appeal to the court to throw out the appeal. Judge F.Gasimov issued a decision to throw out the case after a consultation.

The lawsuit stems from an article published on 5 January in Yeni Musavat about J.Aliyev. J.Aliyev filed a lawsuit in the special format under articles 147 (defamation) and 148 (insult) of the Criminal Code claiming that the information in the article “The owner of the hotel about which the President was not happy identified; ‘Baku’ hotel’s owner is J.Aliyev” is degrading to his honor and dignity and does not conform to reality. On 10 February 2010 the judge adopted a decision to throw out the case claiming that the lawsuit was not prepared in accordance with the demands of the legislation.

MP Jalal Aliyev is the brother of late President Heydar Aliyev and the uncle of the incumbent President Ilham Aliyev.

Yeni Musavat newspaper has been published since 1992 and operates as daily newspaper and has large circulation.
