The Institute for Reporters' Freedom and Safety Nakhchivan Autonomous Republic correspondent Hakimeldostu Mehdiyev’s lawsuit against Nakhchivan Internal Affairs Ministry’s Investigator Hikmat Aliyev filed for his inactivity in the Nakhchivan city Court has not been fulfilled.
On 11 June 2009 H.Mehdiyev filed a lawsuit against Nakhchivan Internal Affairs Ministry’s Investigator Hikmat Aliyev in the Nakhchivan city Court and a hearing on this case was held on 19 June 2009 at 10:00 a.m. The plaintiff was not able to participate in the hearing because he received the invitation only after the hearing was held. On June 2 the plaintiff was sent the decision of the court by regular mail.
“In accordance with the Criminal Code of Azerbaijan Republic, the Nakhchivan City Court rejects the lawsuit due to failure of the correspondent to appeal in written form to Investigator Hikmat Aliyev within 20 days of the incident to open a criminal case,” it is noted in the lawsuit.
On 31 January, at approximately 10:00 a.m., Institute for Reporters' Freedom and Safety Nakhchivan Autonomous Republic correspondent Hakimeldostu Mehdiyev was beaten during a gathering held by opposition parties to mark 125th birthday of Mammad Amin Rasulzade in front of "Umid" Party's Nakhchivan department. Someone named Ismayil Ismayilov insulted H. Mehdiyev using inappropriate language. Then that person hit H. Mehdiyev in the face with a ceramic ashtray. As a result, Hakimeldostu Mehdiyev sustained injuries around his eye.
Hakimeldostu Mehdiyev appealed to Nakhchivan Autonomous Republic Internal Affairs Ministry in connection with this incident and the lawsuit was then submitted to Nakhchivan Internal Affairs Ministry’s Investigator Hikmat Aliyev to be considered. However, the investigator did not do anything regarding the incident or he did not inform the injured party of any progress into the case.
