LAWSUIT ON INFORMATION REQUEST NOT FULFILLED

Today, under the chairmanship of Nasimi District Court Judge Mammad Mammadov, a court hearing took place on "Bizim Yol" Newspaper correspondent Natig Adilov’s lawsuit for inactivity in response to an information request against the Chairperson of the State Commission on Student Admission (SCSA) Maleyka Abbaszade.

Both sides made their closing statement. Plaintiff Natig Adilov asked that his claim be fulfilled. He said that SCSA should reply to his information inquiry. Adilov’s defense lawyer said that she fully agrees with N. Adilov, and asked the court to make a special decision for the SCSA to reply to the inquiry and to also adopt a decision against Maleyka Abbaszade.   

The defendant’s lawyer Narmina Bayramova said, “We can’t distribute individual information. This experience is not something that has been established as a result of our 16 years of work. The whole world follows this same practice. Let’s not reinvent this area.”  
After this, the judge left for deliberations. Then Mammedov returned and read the court’s decision. The lawsuit was not fulfilled.  
Adilov told the Institute for Reporters’ Freedom and Safety that he will now file a complaint against this decision in the Appellate Court.
This lawsuit stems from an information request sent by Adilov on 29 November 2007 to the State Students Admission Committee about how Royala Najafov (popular singer Roya) got accepted into Baku State University. According to Adilov this information request was never responded to. The plaintiff was seeking to have the court adopt a decision that State Students Admission Commission Chairperson Malayka Abbaszade must honestly and fully respond to the information request and for a decision to be adopted in accordance with Civil Procedural Code 265.1 that Abbaszade be held responsible for violating relevant legislation.
