TRIAL ON HELD CHIEF EDITOR’S DEATH IN PRISON

On 20 April, Baku Appeals Court heard the appeal filed by the late Tolishi Sado newspaper editor-in-chief Novruzali Mammadov`s widow Maryam Mammadova and son Emil Mammadov against the Nasimi Distrcit Court 27 January, 2010 decision.

The Judge Ilgar Demirov presided over the hearing, the lawyer of journalist’s family Ramiz Mammadov told the Institute for Reporters` Freedom and Safety (IRFS) today.  
According to lawyer Ramiz Mammadov, Azerbaijan Medicine University Examination Department Head Zahid Mammadov testified in the hearing, who said that the medical report regarding the late journalist is true.
The Plaintiffs` lawyer R.Mammadov claimed that the medical report claiming N.Mammadov had hemorrhaging of the brain was ungrounded and false. He also stated that the late journalist had caught a cold when he was taken to hospital, which was not registered in any medical document and he didn’t receive necessary treatment.
Then the Judge I.Demirov rescheduled the next hearing for 29 April, at 10:30 a.m.
BACKGROUND
In 2007, in a closed hearing, Mammadov was sentenced to ten years in jail and charged with high treason.  Mammadov believed that he was jailed with regard to ethnic-political motives and freedom of expression. Mammadov is from the Talysh minority.
The 68 year old editor-in-chief died in the Justice Ministry Penitentiary Services Central Hospital in 2009. Governmental agencies said that his death was due to illness; however the Defense Committee for Novruzali Mammadov`s rights and members of his family said that the editor-in-chief died due to medical negligence.
