Summary: Hearing 3
- Yunis Alasgarov, deputy chief of the 12th police station of Sabunchu District Police Department, testified as a witness for the defence. He stated that he was present during both Bayram Mammadov’s detention and search of his apartment, and that Mammadov was not tortured during his detention;
- During the hearing, lawyer Elchin Sadigov filed a motion to include additional documents in the case file. He argued that the documents were proof that Nizami Guliyev and Intigam Karimov, who are attesting witnesses in the current case, had participated in other cases with the same status. Sadigov also asked the court to call those witnesses for a repeat testimony. The motion was partly granted; the court agreed to include the documents on those witnesses’ involvement as attesting witnesses in other criminal cases in the case file.
- As another defence witness, a now-discharged former district police officer, was not in presence, the court adjourned until the witness’ presence was ensured.
Baku Grave Crimes Court, chaired by Judge Eynulla Valiyev, continued the hearing on the case of NIDA Civic Movement member Bayram Mammadov, who is facing drug charges.
Examination of defence witnesses:
Yunis Alasgarov, deputy chief of 12th police station of Sabunchu District Police Department, testified as a witness. According to him, Baku City Main Police Office (BCMPO) received a report that Bayram Mammadov was in possession of drugs, and BCMPO turned to the 12th police station of Sabunchu District Police Department for assistance. “I went together with several colleagues to provide assistance. Bayram Mammadov was detained and taken to Baku City Police Office. He was searched and drugs were found in his trouser pocket. He later said the rest of the drugs were in his apartment. We went to Bayram Mammadov’s house together with him. At home, he took the [drugs] out of the base unit of his computer and handed them over,” said the witness.
Yunis Alakbarov said Bayram Mammadov had not been subjected to any physical or psychological pressure.
During the hearing, lawyer Elchin Sadigov filed a motion to add new documents to the case file. The presiding judge then announced that the second witness for the defence, Ramin Aslanov, had been discharged by police and therefore could not be called in.
Lawyer Elchin Sadigov stated that the court could obtain the registered address of Ramin Aslanov and summon him to court.
Taking this into consideration, the court postponed the hearing until 11am, 2 December, in order to issue a summons to the witness.
