CITIZEN’S APPEAL DENIED

The Baku Appeals Court heard the appeal filed by  citizen Shargiyya Rzayeva against Baku Local  Economic Court’s June 22, 2011 decision on an information request she sent in. Judge Sariyya Seyidova presided over the hearing. Citing that the information Rzayeva had sought was information only to be used in direct service of the state, the Judge refused to grant the appeal.

After the hearing, Rzayeva’s lawyer Elmar Suleymanov said that he will take the issue to the higher courts, on the grounds that according to the Law on Mass Media, the information requested by Rzayeva should not be classified like this,  and so the decision is illegal.
 
Shargiyya Rzayeva is one of the residents who lost her apartment when a building on 613 Basti Bagirov street, Baku collapsed. She was offered a new apartment to replace her old one. She sent inquiries to the specific governmental committee set upto investigate this incident, to   the Ministry of Emergency Situations, and to State Agency on Construction Safety, asking why the area of this apartment had been recorded as smaller than its real size, and requested the copies of the relevant documents. When she did not receive a response, she appealed to  Baku Local Economic Court # 1.  On June 22, 2011, the Court rejected the appeal.
