Today, 7 July, in the Yasamal District Court, under the chairmanship of Judge Khagani Mammadov, a hearing was held on Yasamal District Executive Administration Head Ibrahim Mehdiyev’s special format lawsuit against citizen Yagub Muradzade.
The plaintiff’s representative Azer Tagiyev and the defendant Yagub Muradzade and his representative Alibaba Rzayev participated in the hearing.
Alibaba Rzayev claimed that a violation of the law occurred when they agreed upon a decision concerning his appeal that was filed during the preliminary hearing in connection with the Yasamal District Court Board. He noted that in the appeal, they asked to send the case to a different court.
“However, the decision of the court’s chairman indicates that the appeal was not fulfilled because it was allegedly filed against Judge Khagani Mammadov,” said Rzayev.
A.Rzayev presented the same objection to the judge again. However, the judge decided not to consider the objection.
The plaintiff’s representative Azer Tagiyev filed a motion for the appeals in question to be sent for linguistic examination to specify if insulting expressions were used in them or not.
The judge fulfilled this motion and told both sides to present the questions they want to submit to the examination experts on 15 July at 10:00 a.m.
I.Mehdiyev sued Yagub Muradzade in a special format lawsuit under the articles 147 (defamation) and 148 (insult) of the Criminal Code claiming that he was subjected to insult and defamation in the complaint letters regarding Mehdiyev written by Yagub Muradzade to the different state organs.
Y. Muradzade states that he was the editor of Yeni Gazet, which was published from 2004 to 2006 but does not operate currently.
