European Court announces five new decisions on Azerbaijan

On September 29, the European Court of Human Rights (ECHR) announced  five new decisions on 26 complaints sent from Azerbaijan.

The court declared 2 complaints inadmissible, in other cases the parties reached an amicable agreement, according to the website aihmaz.org.

In the case of Saryev and 14 other applicants against Azerbaijan, the applicants complained of a violation of their right to assembly (Article 11). Since the parties reached an amicable agreement at the communication stage, the ECHR decided to exclude applications from the list of consideration.

Under the settlement agreement, the government will pay the 15 applicants a total of EUR 39,000 in non-pecuniary damages and EUR 6,000 in legal costs.

The applicants in this case are: Nurlan Sariyev, Kazim Imanov, Majnun Piraliev, Araz Samadov and Shafag Samadova, Ilham Huseynov, Yalchin Abdullayev, Emil Salimov, Sagif Gurbanov, Emil Maniyev, Bahruz Hasanov, Agil Maharramov, Ruslan Nasirov, Yalchin Abdullayev, Maharram Rzayev, and Fizuli Huseynov.

The second case – Shakhhuseynov and 7 other applicants against Azerbaijan was also related to the violation of the right to assembly. And in this case, the parties reached an agreement at the communication stage. According to the agreement, the government will pay 8 applicants a total of 20,800 euros in compensation for non-pecuniary damage and a total of 1,000 euros in reimbursement of expenses. The applicants in the case are: Fizuli Shahhuseynov, Imamaddin Maharramli, Muhammad Gabibov, Salman Sultanov, Azer Shamkhalov, Ayaz Maharramov, Khalki Huseynov and Valikhan Huseynov, Babek Gasanov.

It should be noted that most of those who reached an amicable agreement with the authorities in the two cases mentioned above are opposition activists. Their complaints were sent in 2017 and 2019.

Another case of Elchin Rashidov against Azerbaijan was related to non-execution of decisions of national courts. Here, too, the parties reached an amicable agreement and the case was excluded from the list of cases under consideration. The government will pay the applicant 3,250 euros.

The European Court refused to consider two more complaints from Azerbaijan.
