FIRED STUDENT AGAIN SUES AZERBAIJAN STATE OIL ACADEMY RECTOR

Today, 6 January, Nasimi District Court held a preliminary hearing on the former student of Azerbaijan State Oil Academy (ASOA), journalist Elmin Badalov’s second lawsuit against ASOA and its rector Siyavus Garayev. Judge Khumar Mardanova presided over the hearing, Badalov told IRFS.

The defendant side’s lawyer Ilgar Javadov said that the article titled “Student wants to make his rector kneel down before him” published in Gundam newspaper on 25 December, 2010, includes ungrounded claims about ASOA and damaged its image. He presented the newspaper to the Judge.
Judge said that the newspaper was added to the case materials and the process was rescheduled to 10.30 am, 26 January.
Elmin Badalov is employed at Yeni Musavat newspaper at present.
BACKGROUND
Elmin Badalov was dismissed from State Oil Academy on 19 January, 2010. On 12 November 2009 Bedelov published on the pia.az website an article titled “Reportage from Azerbaijan State Oil Academy” regarding incidents of bribery and financial fraud in the Azerbaijan State Oil Academy. The student-journalist claims that the harassment he faced and his failures at the university are because of his articles. He had filed a lawsuit to Nasimi District Court to restore his right to education. On 5 April, 2010 the Nasimi District Court rejected the lawsuit of Badalov against Azerbaijan State Oil Academy and rector Siyavush Garayev. On 2 July, 2010, Baku Appeals Court upheld this decision as well. On November 23, the Supreme Court upheld the Appeals Court decision.
