HOLD ON EYNULLA FATULLAYEV’S BANK ACCOUNT BASED UPON ACQUITTAL

Azerbaijan International Bank sent an official response to imprisoned jouranlist Eynulla Fatullayev’s lawyer Elchin Sadigov regarding the court-issued hold on the journalist’s bank account, reports Mediaforum .

Back in October, the  European Court of Human Rights ruled for 27,822 AZN compensation to be given to Eynulla Fatullayev by the Azerbaijani government. The government has transferred the money, but the account is still under a court hold.  The bank told Fatullayev’s father that a held acocunt cannot be accessed. Eynulla Fatullayev sent an official letter to Bank President Jahangir Hajiyev on January 19, 2011 requesting further information.
Fatullayev’s authorized representative in this matter Anar Gasimov said that the response letter had been sent a few days ago.
The letter reports that on August 24, 2007, Sabayel District Court issued a hold on Fatullayev’s account at International Bank. The lawyer was also provided with the copy of the decision.
Gasimov says that the decision was based on the criminal case opened under charges of terrorism, for which his client has been acquitted.  “We filed an appeal to the European Court on this charge. Then the Supreme Court approved the ECHR decision and issued an acquittal.”
“Given these facts, the attendant court hold is groundless. We may go to the Sabayel District Court to remove the hold.”
