Today, 31 March, in the Khatai District Court, under the chairmanship of Judge Togrul Aliyev, a hearing was held on the lawsuit of “Azadlig Harakatchilari” Union Chairman Tahmasib Novruzov (to defend his honor and dignity) against “Nota” Newspaper.
Judge T. Aliyev opened the hearing and listened to a speech from Faramaz Novruzoglu. who wrote articles in question – “Whose orders is Tahmasib Novruzov fulfilling”, “Anti-Terror Center threatens our citizens”, “Who is NSM’s person in APA”, “Bahlul Muradova raises one more criminal case”, “Let your mother die, hey Ramazan”, and “Who are forces that want the name of Sevil Nuriyeva to be mentioned in our newspaper.” These were published under the pseudonyms “Aytan Shirin”, “Javidan”, and “Gorkhmaz Saleh”. Novruzoglu stated that honor and dignity of “Azadlig Harakatchilari” Union Chairman Tahmasib Novruzov have not been insulted in the articles. Novruzoglu added that some of the articles were written based on the journalist’s conversations with T. Novruzov via phone and he published exactly what Novruzov said in the newspaper.
“Azadlig Harakatchilari” Union Chairman Tahmasib Novruzov confirmed that he told Novruzoglu some of the information himself; however, he was not told that they would be published in the newspaper. Novruzov emphasized that these articles are against the law on mass media and have damaged his business image.
The judge asked the parties to make their final speeches. “Nota” Newspaper Editor-in-Chief S. Alibayli, a defendant, asked the judge not to fulfill the lawsuit. T. Novruzoglu asked the judge to adopt a decision to fulfill the lawsuit, and to demand that “Nota” Newspaper apologize and publish a refutation, but left it up to the judge the amount of the compensation for moral damages.
Judge T. Aliyev announced a consultation. Then the judge issued a decision to fulfill the lawsuit partially; “Nota” Newspaper must publish a refutation about the articles being wrong and apologize.
This lawsuit stems from articles – “Whose orders is Tahmasib Novruzov fulfilling” (1-7 February, 2009, edition 04 (018), “Anti-Terror Center threatens our citizens” (8-14 February, edition 05 (019), “Who is NSM’s person in APA”, “Bahlul Muradova raises one more criminal case” (22-28 February, 2009, edition 07 (021), “Let your mother die, hey Ramazan” (01-07 March, edition 08 (022), and “Who are forces that want the name of Sevil Nuriyeva to be mentioned in our newspaper” (08-14 March, 2009, edition 09 (023). These were all published in “Nota” Newspaper.
In the lawsuit it was demanded that “Nota” Newspaper pay compensation in the amount 120,000 AZN, apologize and a refutation be published in the newspaper.
