MOTION FILED IN PROSECUTOR’S OFFICE BY ZAMIN HAJI’S LAWYER NOT FULFILLED

The motion filed in the prosecutor’s office by "Yeni Musavat" Newspaper column writer Zamin Haji's lawyer Fariz Namazli has not been fulfilled. Fariz Namazli told the Institute for Reporters' Freedom and Safety that on 30 January he addressed a motion to the Binagadi District Prosecutor’s Office, Investigator Ilyas Seyidov.

It is noted in the lawsuit that Karabagh Liberation Organization (KLO) Chairman Akif Nagi and three more people attacked Zamin Haji, and it is demanded that a criminal prosecution under articles 132, 221 and 163.1 (hooliganism, interference in legal work of journalist and physical harassment) be conducted against Akif Nagi along with the other three people.

“The prosecutor’s Office did not accept the motion,” said F. Namazli. “I was told that only motions addressed to the name of regional prosecutor.”

Lawyer F. Namazli said this is contradictory to the presidential decree on “Clerk’s work” and he will file a lawsuit against the prosecutor’s office if his motion is not accepted within ten days.

On 12 December 2008, in the evening hours, KLO Chairman A. Nagi along with several people attacked "Yeni Musavat" Newspaper’s editorial office, insulted newspapers employee Z. Haji and used physical pressure against him. The preliminary investigation in connection with the issue was carried out in the Binagadi District Police Department #5. At present the case is under consideration of the investigator of the Binagadi District Prosecutor's office Ilyas Seyidov.

A criminal case has been opened against A. Nagi under article 163.1 (interference in the legal work of a journalist) of the Criminal Code.
