- ➢ Lawyer Elchin Sadigov filed a motion to conduct a handwriting analysis;

At the hearing, Mehman Huseynov’s lawyer Elchin Sadigov filed a motion. “I do not agree with Nasimi District Court’s decision of 10 January 2017 because, as stated in the appeal, Akram Tahmazov assaulted Mehman Huseynov on 26 December 2016. Their staged plot failed because of Mehman Huseynov’s alertness. On 9 January this year, Tahmazov committed similar acts against Huseynov. This time, although Mehman did not resist the policemen, they detained Mehman without drawing up an administrative report. During the arrest, they electrocuted Huseynov, and the youth’s tongue rolled back, his health deteriorated and he fainted. Taking advantage of the blogger’s unconsciousness, the police officers had him sign the report. It is evident that one person had not executed the signatures. The signatures do not match each other. Therefore, I filed a motion to conduct a handwriting analysis on whether or not the signatures belong to Mehman Huseynov, but the motion was denied. Now, I want to file that motion again, so that the authorities conduct a handwriting analysis and ask the expert whether the signatures belong to Mehman Huseynov,” Sadigov said.
Mehman Huseynov requested that the motion be granted. Judge Mirpasha Huseynov denied the motion after a brief deliberation.
Further on, blogger’s lawyer Elchin Sadigov requested the court to grant the appeal, which sought discontinuation of the proceedings on the administrative case and repeal of Nasimi District Court’s decision of 10 January 2017.
Blogger Mehman Huseynov also asked the court to sustain the appeal. “200 manat is nothing. I have raised this in one-kopeck coins. I suggest that you do not torture Nasimi District workers because they will have to count those kopecks. Revoke Nasimi District Court’s decision, and let’s go and mind our own affairs,” Huseynov said.
After a brief deliberation, the judge announced that the appeal was dismissed.
Background: Blogger Mehman Huseynov was detained by the police at evening hours on 9 January. A criminal case was launched against him under Article 535.1 (disobedience to lawful requirements of the police) of the Administrative Violations Code. On 10 January, Nasimi district court fined him 200 AZN after which he was released. Following the hearing, Huseynov told the journalists that the police had tortured him. On 11 January, Mehman Huseynov’s lawyer Elchin Sadigov disseminated photos showing injuries on his body and blood stains on his clothes.
Along with taxing the blogger, Nasimi District Court also ordered that the prosecutor’s office investigates his torture complaints.
