ROVSHAN KABIRLI AND YASHAR AGAZADE’S LAWSUIT NOT FULFILLED

April 13th, 2009
On 10 April, in the Sabail District Court, under the chairmanship of Judge Elnur Hasanov, a hearing was held on the lawsuit of "Mukhalifat" Newspaper Editor-in-Chief Rovshan Kabirli and the newspaper's Department Editor Yashar Agazade against the Ministry of Justice, Ministry of Justice's Penitentiary Services and Penitentiary Services' Investigative Detention Center #1 (Bayil Prison) over poor prison conditions.

The judge did not fulfill the journalists’ lawsuit.
Y. Agazade told the Institute for Reporters’ Freedom and Safety that he and Kabirli will file an appeal against the decision as soon as they receive the decision.
The plaintiffs claimed that beddings were not changed when they were held in the Investigative Detention Center #1 (Bayil Prison), food rations were less than what is shown in the law, they were held in very small cells and sometimes were not given any food at all.
The plaintiffs are seeking 40,000 AZN in compensation for moral damages.
“Mukhalifat" Newspaper Editor-in-Chief Rovshan Kabirli and the newspaper's department editor Yashar Agazade were held in the Investigative Detention Center #1 for five months in 2007 due to a lawsuit filed against them by parliamentarian Jalal Aliyev, who is also the president’s uncle.
