Today, 9 October, in the Baku Appellate Court, under the chairmanship of Judge Gail Mammadov, a decision was issued on the appeal of both parties against the decision of the Nizami District Court adopted on the special lawsuit of Internal Army Commander, General Lieutenant Zakir Hasanov, Internal Army Deputy Commander Fakhraddin Samadov, Internal Army Staff Department Head, Colonel Nasir Huseynov and Internal Army Financial Manager Namig Poladov against “Nota” Newspaper Editor-in-chief Substitute Sardar Alibeyli.
Judge issued a decision to change the decision of the first instance court and to find Sardar Alibayli guilty under article 147.1(Libel, an act of communication during mass speeches, in mass circulated work or in mass media outlets that causes someone shame and damages his/her reputation) of the Criminal Code and to sentence Sardar Alibayli to total four months imprisonment together with the decision made by the Appellate Court yesterday to sentence Sardar Alibeyli to three months imprisonment.
The plaintiffs filed a lawsuit against the editor-in-chief substitute of the newspaper Sardar Alibeyli under article 147.2 (libel in accusing someone of grave or especially grave crime) of the Criminal Code over article published in Nota” newspaper about the Internal Army and on 20 July the court issued a verdict to sentence the defendant to 7 month conditional imprisonment and to pay 4% of his monthly salary to the government. The plaintiff filed an appeal to increase the punishment and the defendant filed an appeal to annul the decision and to be justified.
Yesterday, 8 October, in the Baku Appellate Court, Judge Jamal Ramazanov issued a verdict to uphold the decision of the Nizami District Court adopted on the lawsuit of “Azadlig Harakatchilari” Union Chairman Tahmasib Novruzov against “Nota” Newspaper Editor-in-chief Substitute Sardar Alibeyli (Aliyev) under article 148 (insult) of the Criminal Code, newspaper’s employees Ramiz Tagiyev and Faramaz Novruzoglu (Allahverdiyev) under article 147.2 (accusing someone of grave or especially grave crimes) of the Criminal Code in the special format. Sardar Alibeyli and Faramaz Novruzoglu were sentenced to 3 months imprisonment, and Ramiz Tagiyev was sentenced to 6 months corrective labor.
