
Plaintiff Mammadmusa Huseynov, defendant Sabuhi Mammadli and defendant’s representative Elchin Sadigov participated in the hearing.
Plaintiff M. Huseynov said that articles damaging to my honor and dignity have been published in “Yeni Musavat” newspaper since Majidova sisters disappeared in the Davachi Region's Dagbilici village. He asked the judge to open a criminal case against "Yeni Musavat" Newspaper employees Sabuhi Mammadli and Ervin Mirza under article 147.1 of the Criminal Code to bring them to responsibility and to adopt a decision regarding 100 000 AZN compensation for moral damages.
Defense lawyer Elchin Sadigov emphasized that Ervin Mirza is Sabuhi Mammadli’s penname and Sabuhi Mammadli did not write those articles from his imagination, but based on “Bizim Yol” Newspaper and the parents of the disappeared sisters. Therefore, the lawyer filed a motion to reject the lawsuit without conducting a trial.
Judge Natig Abbasov fulfilled the motion and rejected the lawsuit.
Mammadmusa Huseynov appealed to court after articles “Deputy Police Chief Ordered to Kidnap Majidova Sisters” (16 November 2008) and “Davachi’s Former Deputy Police Chief under Home Arrest” (20 November 2008) were published in “Yeni Musavat” Newspaper. M. Huseynov claimed that his honor and dignity were insulted in those articles.
