STUDENT-JOURNALIST’S APPEAL WAS NOT FULFILLED

Today the Baku Appeals Court heard the appeal of former Azerbaijan State Oil Academy (ASOA) student Elmin Badalov against the Nasimi District Court’s 2 February 2011 decision which refused to fulfill the second lawsuit of the expelled student against the Academy and its rector Siyavush Garayev, Badalov told IRFS.

Judge Huseynova upheld the decision, Badalov reported to IRFS.
Deeming the decision unfair, Badalov says that he will take the issue to the Supreme Court.
BACKGROUND
Elmin Badalov was dismissed from State Oil Academy on 19 January, 2010. On 12 November 2009 Bedelov published on the pia.az website an article titled “Reportage from Azerbaijan State Oil Academy” regarding incidents of bribery and financial fraud in the Azerbaijan State Oil Academy. The student-journalist claims that the harassment he faced and his failures at the university are because of his articles. He had filed a lawsuit to Nasimi District Court to restore his right to education. On 5 April, 2010 the Nasimi District Court rejected the lawsuit of Badalov against Azerbaijan State Oil Academy and rector Siyavush Garayev. On 2 July, 2010, Baku Appeals Court upheld this decision as well. On November 23, the Supreme Court upheld the Appeals Court decision.
