On 21 October, Baku Appeals Court held a preliminary hearing on the appeal of Yeni Musavat newspaper against the 13 July 2011 resolution of Nizami District Court.
Judge Togrul Aliyev presided over the hearing.
The lawyer of Yeni Musavat newspaper, Vagif Huseyn, reported to IRFS today that the document enforcing the Nizami District Court’s 15 June 2011 resolution was not properly compiled. He said:
“In the document enforcing the resolution, the requirements of article 7 of the Law on the Execution of a Court Decision were violated. In addition, the document did not include Goshgar Bakili and Azer Aykhan in the list of debtors. The person actually named, Goshgar Bakili, doesn’t work at Yeni Musavat newspaper. That is why, it is impossible to hold such a trial”
He also said that he scheduled the next hearing for 28 October at 12:50 pm.
BACKGROUND
The uncle of President Ilham Aliyev, MP Jalal Aliyev sued Yeni Musavat newspaper after an article published in January 2010: “Owner of the hotel which disappointed the President has been found: Baku Hotel is owned by Jalal Aliyev”. On June 15, 2010, Nizami District Court partially granted the lawsuit, ruling that the newspaper should officially refute the contents of the article and pay 1500 AZN in compensation (as opposed to the 50,000AZN that Aliyev applied for).
In addition, Gilan Gabala Canery LLC sued Yeni Musavat newspaper for the article “Juice called JALE is Very Dangerous” published in Yeni Musavat newspaper in April of 2009. Gilan believes that this article is damaging to the business image of the company.
Yeni Musavat newspaper has been publishing since 1989 and is a daily newspaper.
