TURAN INFORMATION AGENCY LAWSUIT AGAINST MINSITRY OF ECOLOGY AND NATURAL RESOURCES: DISMISSED

Today the Yasamal District Court heard the lawsuit brought by Turan Information Agency against the Ministry of Ecology and Natural Resources (MENS). The case was heard by Judge Sardar Mehraliyev.

The attendees included the Agency lawyer Elchin Sadigov and the defendant’s lawyer Chingiz Najafov.
Elchin Sadigov requested the Court to consider the Constitutional right to obtain information, and to to fulfill the lawsuit on those grounds.
Lawyer Najafov claimed the inquiry in question was being brought with the sole aim of discrediting the Ministry.
After deliberation, the Judge ruled to dismiss the lawsuit.
After the hearing, lawyer Sadigov told Objective TV that Turan would be appealing against the decision.
BACKGROUND
On September 21, Turan Information Agency submitted an inquiry to the Ministry of Ecology and Natural Resources regarding the delta of the Kur River, which was subject to severe flooding. This flooding damaged hundred thousands of farms, millions of square meters of residential areas, and caused the deaths of cattle and other animals across several regions of Azerbaijan.  When the Ministry failed to respond to their inquiry,Turan filed a lawsuit citing violation of Articles 24 (Term of Execution of the Request for Information), 29 (Information Owner’s Obligation to Disclose the Information), 37 (Limitation on Considering the Information as Intended for Official Use).
