Today, 2 April, in the Baku Appellate Court, under the chairmanship of judge Mehpara Ahmadova, a hearing was held on the lawsuit of the Head of the Center for Assistance to Free Economy Zohrab Ismayil against the decision of the Sabail District Court.
Z. Ismayil appealed to the Sabail District Court due to an incomplete answer to an information inquiry he sent to State Oil Fund of Azerbaijan Republic. The court did not fulfill the lawsuit, claiming that the information Ismayil was seeking is considered a trade secret.
During today’s hearing Ismayil’s lawyer, Media Rights Institute representative Fariz Namazli said that information inquiry he had sent to State Oil Fund of Azerbaijan Republic was responded incompletely and some of the questions were not responded at all.
Defense representative Shain Ismayilov said that SOCAR regularly publishes its annual report and that the annual report of SOCAR, along with the questions asked, has been sent to the plaintiff. And some of the questions were not responded because they are commercial secrets.
After discussions, Judge M. Ahmadova issued a decision to uphold the lower court’s decision. Head of the Center for Assistance to Free Economy Zohrab Ismayil and Lawyer of the Media Rights Institute Fariz Namazli told the Institute for Reporters’ Freedom and Safety that they will appeal to the Supreme Court.
