HEARING FOR “GUNDALIK BAKI” POSTPONED AGAIN

Yesterday, 26 February, in the Yasamal District Court, under the chairmanship of Judge Tahir Ismayilov, a preliminary hearing was held on the lawsuit put forth by Head of Caucasus Muslims Department Sheykul-Islam Allahshukur Pashazade against "Gundalik Baki" Newspaper for defense of honor and dignity.

The plaintiff’s lawyer Zaur Ibadov filed a motion to consider the joining of A.Pashazade’s brother Javanshir Pashazade in the lawsuit as the third party.  Ibadov stated that “Bayram-M”, “Haji Mazan” and “Ashrafi” firms have also filed a lawsuit against “Gundalik Baki” newspaper in accordance with this lawsuit and each of these are considered by different judges. “Either these lawsuits should be merged and considered by one judge or J.Pashazade’s lawsuit should be separated from Allahshukur Pashazade’s lawsuit and considered by a different judge,” said Ibadov.
Plaintiff’s lawyer Mukhtar Mustafayev responded that consider the joining of A.Pashazade’s brother Javanshir Pashazade in the lawsuit conforms to the requirements of article 55.1 of the Civil Precedural Code.
To consider the motion, Judge T. Ismayilov postponed the preliminary hearing until 27 February.
A. Pashazade filed a lawsuit against "Gundalik Baki" Newspaper due to article "Narcotics Itinerary in the South – 2" published in the newspaper on 14 January, 2009. Pashazade claims that his honor and dignity was damaged and demands that the newspaper publish a refutation and apologize.
