APPEAL OF YENI MUSAVAT NEWSPAPER NOT FULFILLED

Yesterday, 22 June, in the Baku Appellate Court, under the chairmanship of Judge Medine Bagirova, a hearing was held on Yeni Musavat newspaper’s appeal against the decision of Yasamal District Court

that was adopted on the newspaper’s lawsuit against the State Customs Committee on 16 March, 2010, regarding the Committee’s failure to answer to an information inquiry. The Institute for Reporters` Freedom and Safety was told this by Yeni Musavat Newspaper attorney Vagif Huseyn.

 

The Plaintiff’s representative, V.Huseyn, and State Customs Committee Law Department Director Senan Mukhtarov participated in the hearing.

The Judge issued a decision to uphold the decision of the Yasamal District Court. V.Huseyn added that they will file a cassation complaint against the decision.

 

The lawsuit stems from the failure of the State Customs Committee to respond to the information inquiry of Yeni Musavat newspaper.

 

In the inquiry information the newspaper requested information regarding customs incomes (VAT, customs taxes) for imports to Azerbaijan, sections, goods groups and indicators on the most important goods (including cars), and the total amount of imported goods which are freed from the customs incomes and their contents on each separate year between 2004-2008. On 16 March, 2010, the Yasamal District Court issued a decision not to fulfill the lawsuit.
