Imprisoned Editor-in-Chief of “Gundalik Azerbayjan” and “Realny Azerbayjan” newspapers Eynulla Fatullayev’s lawsuit against Minister of Foreign Affairs Elmar Mammedyarov will be considered by the Appellate Court. A hearing will take place in the Appellate Court tomorrow, February 10, at 3 p.m. The Institute for Reporters’ Freedom and Safety was told this by Fatullayev’s lawyer, Isakhan Ashurov.
This case stems from an unanswered information request the Fatullayev addressed to Mammedyarov, and the Yasamal District Court refused to consider the complaint.
According to Mammedyarov, Fatullayev's article “The Aliyev’s Are Going to War” disturbed foreigners and businessmen. In connection with this, Fatullayev sent an information request to Mammedyarov and sought to learn the identities of the foreigners and businessmen.
On 21 April 2007, Fatullayev was imprisoned for two years and six months on libel and defamation charges, and then on 30 October 2007, he was sentenced to a total of 8 years and six months of imprisonment for incitement of terror, incitement of religious hatred and tax evasion, at well as well the former charges of libel and defamation.
