The defendant side reported to the Judge that the document on enforcement of the resolution was not properly compiled: the date of birth, address and other information about Yeni Musavat newspaper editor-in-chief Azer Aykhan was not rightfully provided in the document; the document also did not include Goshgar Bakili in the debtors` list.
After deliberation, Judge Ziya Aliyev announced the decision to uphold the enforcement decision. Lawyer said that they will appeal against this decision.
In the last hearing, Yeni Musavat newspaper had filed a motion objecting to Judge Ziya Aliyev’s presidency in the hearing. Nizami District Court did not grant the motion.
BACKGROUND
The uncle of President Ilham Aliyev, MP Jalal Aliyev sued Yeni Musavat newspaper after an article published in January 2010: “Owner of the hotel which disappointed the President is found: Baku Hotel is owned by Jalal Aliyev”. On June 15, 2010, Nizami District Court partially granted the lawsuit, ruling that the newspaper should offically refute the content of the article and pay 1500 AZN in compensation (as opposed to the 50,000AZN that Aliyev applied for).
Yeni Musavat newspaper has been publishing since 1989 and it is a daily newspaper.
