On November 14th the Baku Appeals Court upheld the original decision of the Baku Administrative-Economic Court #2 on the lawsuit filed by the Gilan Holding LLC against Yeni Musavat newspaper, to impose 50,000AZN fine on the newspaper, as reported by lawyer Elchin Sadigov.
Representatives of both the plaintiff and defendant made speeches before the court. The plaintiff’s representative asked the court to demand that the newspaper publish retraction and pay compensation in punitive damages. After deliberation the judge denied the appeal.
“The appeals court upheld the original decision imposing 50,000AZN fine on the newspaper and requiring a retraction. We will appeal against this decision. If our appeal is denied once again, we’ll take the case to the European Court” said the lawyer.
According to the Yeni Musavat management, the newspaper has faced more than 50 lawsuits in the past 5 years. All of the suits were filed by state officials, public figures and private entities that are directly or indirectly related to the authorities. In most of the cases courts ruled against the Yeni Musavat. Currently the newspaper is facing several lawsuits, which altogether demand that the newspaper pay a total of more than 2 million AZN in compensation. The execution of the court decision requiring Yeni Musavat to pay 4,000AZN to ZQAN Holding president Anar Mammadov has already started.
On July 31st Baku Administrative-Economic Court #2 chaired by judge Khalig Imanov heard the lawsuit filed by Gilan Gabala Cannery LLC against Yeni Musavat newspaper. The Cannery sued the Yeni Musavat for the article “Jale is not 100% pure and natural juice” published in the newspaper in 2009. The judge partially granted the lawsuit and imposed 50,000 AZN fine on the newspaper.
