BLOGGERS GIVE WITNESS ACCOUNTS REGARDING THEIR UNFOUNDED ARREST

Today, 9 October, in the Sabail District Court, under the chairmanship of Judge Araz Huseynov, a hearing was held on the criminal case opened under article 221.2.1(hooliganism)  and 127 (inflicting intentional minor bodily harm) against young bloggers Emin Abdullayev (Millli) and Adnan Hajizade.

The bloggers’ lawyers filed a motion and said that the expert opinion was bogus, and it does not base either on legal or medical documents. Therefore they demanded that it be removed from the evidence list. Judge A.Huseynov did not consider the motion and said that it will be considered during the next hearing.    
Then the young bloggers gave a free witness account. Adnan Hajizade stated that they were beaten by Vusal Mammadov when the incident happened in the restaurant and were insulted by Babek Huseynov.
“Vusal Hasanov, who looked like a sportsman, stroke strong and straight blows and this occurred instantly,” said A.Hajizade. “I fell when Vusal Mammadov hit me with his head (skull) after he did the same thing to Emin Milli. Then he continued to kick me. I felt that the blows stopped, and when I got up I saw that someone blocked Vusal. Later I found out that this was the cook of the restaurant. At this time, I lifted Emin Milli and we ran outside. There I saw that Emin Milli had no shoes on, and his foot was bleeding. Thinking that Babek Huseynov and Vusal Mammadov were coming behind us, we began running towards Favvaralar Meydani spontaneously. In the Favvaralar Meydani we made sure that no one was following us and went to the nearest police department #39.”
Then Adnan Hajizade demonstrated pictures taken by his and his friend’s (who came there later) mobile phone to the hearing participants. Emphasizing that the board “Police Department #39” was reflected in the picture, Adnan Hajizade noted specifically that these pictures were the evidence that the police, Vusal Mammadov and Babek Huseynov, who testified at the court, lied. The police had said that the bloggers were taken to the police department #9 directly from the restaurant.
Adnan Hajizade said that their arrest was related to their active social work and placing video materials about negative incidents on the internet. Hajizade said that the accusation against them was biased and eight references given about him by foreign education centers were not added to the case material. He noted that he has two degrees one of which was received abroad, and he has promoted anti-violence through the youth organization he established. Adnan emphasized that he still has difficulty to breathe due to the injuries he received in his nose when he was beaten. “The doctor who examined me in the prison said that I should have a surgery to breathe normally,” said A.Hajizade.
E.Milli said that he confirmed his testimonies he gave to the investigation and he agreed to Adnan’s speech. “I want to congratulate everyone who celebrate the tearing down the walls of Berlin in Germany,” said E.Milli. “I am sure that this kind of walls and lies in Azerbaijan will be torn down soon.”
Then the lawyers of bloggers told the judge that the injured party V.Mammadov and B.Huseynov did not take part in the hearing for the second time and asked the judge to secure their participation during the next hearing.
The judge scheduled the next hearing on this case for 13 October at 3:00 p.m.
On 8 July, at approximately 8:00 p.m., Emin Milli and Adnan Hajizade were sitting at a table in “Lebonese” (Livan) restaurant along with several other young adults, when two people that looked like sportsmen came up to them, and attacked them causing physical injuries. Although they appealed to police as victims, police detained Adnan and Emin as suspected persons for 48 hours and freed the attackers. On 10 July, the Sabail District Court issued a decision under article 221.2.1 (hooliganism) of the Criminal Code to sentence Emin Milli and Adnan Hajizade to two months pre-trial detention. On July 20 the Appellate Court upheld the decision of the lower court. The investigation of the criminal case was concluded and a criminal case under articles 221.2.1 (hooliganism) and 127 (inflicting intentional minor bodily harm) was opened against E.Millli and A.Hajizade and the case was sent to court to be considered.
