DECISION ISSUED BY CITY COURT IN CONNECTION WITH JOURNALIST`S APPEAL ANNULLED

On 18 August, in the Nakhchivan Autonomous Republic Supreme Court’s Criminal and Administrative Penal Court, under the chairmanship of Judge Vera Guyumova, a hearing was held on the appeal of the Institute for Reporters’ Freedom and Safety Nakhchivan Regional Correspondent Hakimeldostu Mehdiyev against the decision of Nakhchivan City Court adopted on 27 July 2009.

Judge issued a decision to annul the decision of the Nakhchivan City Court and to send it to Nakhchivan City Court to be reconsidered.
On 28 July 2009, during a hearing in the Nakchivan city Court, under the chairmanship of Judge Hijran Muradova, a verdict was issued on the lawsuit of Institute for Reporters' Freedom and Safety Nakchivan regional correspondent Hakimeldostu Mehdiyev against Nakchivan city Police Department Head Sabuhi Novruzov’s inactivity. The judge rejected the lawsuit claiming that the correspondents have not been concerned about the proceedings into the case since they appealed to police.

On 29 January 2009 AT 6:00 P.M, IRFS Nakhchivan regional correspondent Elman Abbasov received a threatening call into his mobile phone. A person, who introduced himself as Malik Ailyev, insulted Elman Abbasov and his colleague Hakimeldostu Mehdiyev and said that he would kill them. M.Aliyev told them that he will explode their editorial office located in the office of Democracy and NGO Development Resource Center at 33 Ataturk Prospect in Nakchivan. About ten minutes later that same person called Radio Free Europe/Radio Liberty, Turan News Agency correspondent Malahet Nasibova and threatened her. On 4 February 2009 at 10:45 p.m. he called Mehdiyev’s phone, threatened them and used inappropriate language against them. Mehdiyev appealed to police regarding this issue and then to court since the police did not take up the issue.
