Yesterday, 24 September, in the Baku Appellate Court, under the chairmanship of Judge Jamila Safiyeva, a hearing was held on the appeal of “Haci Mazan” LTD founder Ramazan Zeynalov against the decision of the Yasamal District Court adopted on the lawsuit against “Gundalik Baki” Newspaper Editor-in-chief and founder Habil Valiyev to defend his honor and dignity.
Ramazan Zeynalov`s representative Rafig Abdullayev and “Gundalik Baki” newspaper founder and editor-in-chief Habil Valiyev participated in hearing.
R.Abdullayev said that the articles in question caused moral damages to Ramazan Zeynalov and because of this, he got diabetes. For this reason, R.Abdullayev demanded that the decision issued by the Yasamal District Court should be annulled, a refutation should be published regarding the articles, and “Gundalik Baki” Newspaper editor-in-chief and founder Habil Valiyev should pay 300.000 AZN to the company.
H.Valiyev said that he did not mention Ramazan Zeynalov, but Haji Mazan in his articles, and therefore R.Zeynalov`s lawsuit is groundless.
During the hearing, the question of the judge – “’Haji Mazan’ in your article represents Ramazan Abdullayev; why didn’t you dare to write his name?” – caused discussion. Habil Valiyev told the judge that asking these kinds of questions gives grounds to say that the decision of the court will not be fair.
The judge scheduled the next hearing on this case for 1 October at noon.
The lawsuit stems from articles "Narcotics Itinerary in the South" published in the newspaper on 14 January 2009 and "Narcotics Itinerary in the South – 2" published in the newspaper on 22 January, 2009. The plaintiff appealed to the Yasamal District Court seeking the publication of a refutation, an apology from the newspaper, and 300 000 AZN from “Gundalik Baki” Newspaper editor-in-chief and founder Habil Valiyev for the company in compensation for moral damages. But the Yasamal District Court did not fulfill the lawsuit.
