Hearing launched on Elmin Badalov’s lawsuit against ASOA

Today (July 19th) the Baku Administrative-Economic Court #1 under judge Gurban Abbasov held a preparatory meeting on the lawsuit brought by Elmin Badalov, former student of Azerbaijan State Oil Academy (ASOA), against ASOA for his expulsion from the academy.

In his suit Badalov asked the court to reinstate him to the academy.
The hearing was attended by Elmin Badalov (plaintiff), his legal representative Fariz Namazli, defendant Gasim Mammadov (deputy rector of the faculty of oil and mechanics of ASOA) and Sakit Hasanov (dean of the faculty of oil and mechanics of ASOA).
When defendant Gasim Mammadov protested against the lawsuit, the jjudge asked him to submit his objection in written form. The hearing is scheduled for August 1st 10:30am.
Elmin Badalov was dismissed from State Oil Academy on January 19 2010. On November 12 2009 Badalov published an article titled “Reportage from Azerbaijan State Oil Academy” on the pia.az website, where he described incidents of bribery and financial fraud in the Azerbaijan State Oil Academy. The student journalist claims that the harassment he faced and his failures at the university are related to this article. He filed a lawsuit with Nasimi District Court against ASOA and rector Siyavush Garayev, which was rejected on April 5 2010. On July 2 2010, the Baku Appeals Court upheld this decision. On November 23, the Supreme Court upheld the Appeals Court decision.  On February 2 2011, the Nasimi District Court rejected Badalov’s second lawsuit against Azerbaijan State Oil Academy and rector. On 2 June 2011 the Appeals Court dismissed his appeal. On December 8th 2011 Nasimi District Court returned his lawsuit noting that it should be considered by the administrative-economic court.
